Binding contracts for Homestay Hosts, Transport Operators, and Tour Guides registered on BiharYaatra

Important Notice for All Providers

By registering as a “Provider” on the BiharYaatra platform and submitting your KYC documents, you legally agree to the following terms and conditions. Please read each section carefully before proceeding with onboarding.

1. Provider Service Agreement

1.1. Nature of Relationship

The Provider (Homestay Host, Transport Operator, or Tour Guide) agrees that they are acting as an independent contractor. This agreement does not create an employer-employee relationship, partnership, or joint venture between the Provider and BiharYaatra.

1.2. Accuracy of Listings

The Provider is solely responsible for ensuring that all images, descriptions, pricing, and availability calendars uploaded to the BiharYaatra Provider Dashboard are 100% accurate.

Warning: If a User arrives at a homestay and the conditions severely mismatch the platform photos, BiharYaatra reserves the right to issue a full refund to the User at the Provider's expense.

1.3. Compliance with Local Laws

The Provider guarantees that they possess all necessary local licenses, permits, and insurance required by the State of Bihar to operate their respective business.

  • Transport operators must maintain valid commercial driving licenses and vehicle fitness certificates.
  • Homestay hosts must comply with all local municipality regulations and safety codes.
  • Tour guides must carry valid government-recognized guide credentials where applicable.

2. Platform Fees & Payout Policy

2.1. Commission Structure

BiharYaatra charges a Platform Commission for every successful booking facilitated through the website. The commission rate is dynamically agreed upon during the provider onboarding process. This fee is automatically deducted from the total booking amount paid by the User.

2.2. Escrow & Payout Timeline

To protect the User, all funds are held in an escrow account managed by Razorpay.

Booking Payment

User pays the full amount. Funds are held securely in the Razorpay escrow account.

Trip Completion

Provider's net payout (Booking Amount minus Platform Commission) is marked as “Cleared” after the trip is marked completed in the Admin Dashboard.

Remittance

Funds are transferred to the Provider's registered bank account within 3 to 5 business days following successful service completion.

2.3. Provider-Initiated Cancellations (Penalties)

If a Provider cancels a confirmed booking without a valid, documented emergency (e.g., severe illness, natural disaster):

  • The User will be fully refunded.
  • The Provider may be charged a penalty fee (deducted from future payouts) to cover the platform's payment gateway costs.
  • Repeated cancellations will result in permanent suspension from the BiharYaatra platform.

3. Code of Conduct & Anti-Circumvention Policy

3.1. The Anti-Circumvention Rule (No Offline Deals)

The Provider explicitly agrees not to bypass the BiharYaatra platform to avoid paying commission fees.

If a User discovers your service through BiharYaatra, the Provider is strictly prohibited from asking the User to cancel their digital booking and pay in cash upon arrival.

Violation of this rule is a breach of contract and will result in immediate and permanent termination of the Provider's account.

3.2. Professional Conduct & Safety

The Provider must maintain the highest standards of hospitality, hygiene, and safety.

  • Any reports from Users involving harassment, discrimination, or unsafe driving practices will trigger an immediate investigation by the BiharYaatra Admin team.
Investigation Protocol: During an active investigation, the Provider's listings will be temporarily suspended (hidden from public view) and any pending payouts will be frozen until the dispute is resolved.

3.3. Review Manipulation

Providers are strictly prohibited from:

  • Submitting fake reviews for their own listings.
  • Incentivizing Users to leave 5-star reviews in exchange for cash discounts.
  • Harassing Users who leave negative feedback.

Acceptance of Terms

Digital Signature

Checking the “I Agree to the Provider Terms and Conditions” box during the dashboard onboarding process constitutes a legally binding digital signature.
